TANGRAM FLEX, INC. (“Tangram” or “we”) respects your (Customer) privacy and is committed to protecting it through our compliance with this Privacy Policy (“Privacy Policy,” or “Policy”). This Policy describes the types of information we may collect from you or that you may provide when you install, register with, access, or use our Tangram Products. This Policy describes our practices for collecting, using, maintaining, protecting, and disclosing that information. This Privacy Policy is incorporated by reference into Tangram’s Terms of Use, which are available at: https://tangramflex.com.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to register with, install, access, or use the Tangram Products. By installing, registering with, accessing, or using Tangram Products, you agree to this Privacy Policy. This Privacy Policy may change from time to time (See Section 9: Changes to Our Privacy Policy). Your continued use of Tangram Products after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy from time to time for updates.

1. Definitions. Capitalized terms used herein shall have the meanings set forth in this Section

A. “Agreement” means the Software License Agreement and any other agreement or contract entered into between Tangram and Customer that is governed by or otherwise incorporates this Policy.

B. “Customer” means any individual purchasing or accessing Tangram Products under the terms of an Agreement. This includes all Customer employees accessing the Tangram Products, or (b) employees of Customer’s consultant(s) or subcontractor(s) who access Tangram Products on behalf of the Customer.“

C. Personal Information” means information that Customer provides or for which Customer provides access to Tangram, or information which Tangram creates or obtains on behalf of Customer, in accordance with the Agreement that: (i) directly or indirectly identifies an individual; or (ii) can be used to authenticate an individual. Customer’s business contact information is not by itself Personal Information.

D. “Tangram Products” means any product, software, and/or service provided by Tangram to Customer under or in connection with any Agreement.

1. No Children Under the Age of 18 The Tangram Product is not intended for children under 18 years of age. No one under age 18 may provide any information to or in connection with the Tangram Products. We do not knowingly collect information from children under 18. If you are under 18, do not install, register with, access, or use the Tangram Products, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. 2. Information We May Collect About You, How We Collect It, and Information You Provide to Us

‍We may collect certain types of information from and about users of our Tangram Products. When you install, register with, access, or use the Tangram Products, we may collect or ask you provide information:

By which you may be personally identified, such as name, e-mail address, account identification numbers, and/or passwords, and/or any other identifier by which you may be contacted online or offline (“Personal Information”); and/or
That is about you but individually does not identify you, such as technical or device-specific information such as your browser type, usage data, computer type, computer or device operating system, your search queries, and technical information about your means of accessing the Tangram Products.

This Policy applies to information we collect:

Directly from you when you provide it to us directly or through the use of functions on the Tangram Products. These may include information that you provide by filling in forms on Tangram Products, including at the time of registering to use the Tangram Products, your search queries in the Tangram Products, and details of transactions or entries you carry out through the Tangram Products.
In email, text, and other electronic messages sent through or in connection with the Tangram Products.

It does not apply to information that:

We collect through any other means, including on any website or other applications operated by Tangram or any third party, including third-party websites you may access through the Tangram Products; or
You provide to or is collected by any third party, including your employer.

3. User Contributions.

‍You also may provide information to be transmitted to other users of the Tangram Products or third parties, such as your employer (collectively, “User Contributions”). Your User Contributions are transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users of the Tangram Products with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. 4. How We Use Your Information

‍We may use the information we collect from you in the following way and for the following reasons:

To present to you the Tangram Products and/or its contents, and any other information, products, or services that you request from us.
To respond to customer service requests from you and support your needs.
To fulfill any other purpose for which you provide it.
To provide you with notices about your account.
To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including the Terms of Use.
To notify you about changes to the Tangram Products, when Tangram Products updates are available, and/or any products or services we offer or provide through them.
To personalize your experience on the Tangram Products.
To aggregate user information to better understand our users’ needs or challenges.
To improve our Tangram Products interface, experience, or functionality.
To carry out our obligations and enforce our rights arising from any misuse of the Tangram Products.
In any other way we may describe when you provide the information.
For any other purpose with your consent.

5. Disclosure of Your Information

‍We may disclose aggregated information about our Users, and information that does not identify any individual or device, without restriction.

In addition, we may disclose Personal Information that we collect or you provide to us:

To our subsidiaries and affiliates.
To contractors, service providers, and other third parties we use to support our business.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Tangram ’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Tangram about Tangram Products users is among the assets transferred.
To fulfill the purpose for which you provide it.
For any other purpose disclosed by us when you provide the information.
With your consent.

We may also disclose your Personal Information:

To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
To enforce or apply our rights arising from any contracts entered into between you and us, including the Terms of Use and other agreements.
If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Tangram, our customers, or others.

6. Accessing and Correcting Your Information

‍You can review and change your personal information by logging into the Tangram Products and visiting your account page. Additionally, you may send us an email at support@tangramflex.com to request access to or to correct any Personal Information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.If you delete your User Contributions from the Tangram Products, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Tangram Products users. Proper access and use of information provided on the Tangram Products, including User Contributions, is governed by our Terms of Use.

7. Data Security

‍We maintain measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. That said, the safety and security of your information ultimately depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Tangram Products, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We make no guarantees on the security of your Personal Information transmitted through the Software Tangram Products. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Tangram Products or your network.

8. Changes to Our Privacy Policy

‍We may revise and update this Policy from time to time at our sole discretion, and in such event we will make reasonable efforts to notify you of such changes, which may include a pop-up or banner within the Tangram Products, by sending an email to any address you may have used to register for an account, via posts at, or through other similar mechanisms. All such changes are effective upon publication. You will be responsible for reviewing and becoming familiar with any such modifications.Your continued use of the Tangram Products following the posting of revised Privacy Policy means that you accept and agree to the changes. You are expected to review the Privacy Policy from time to time so you are aware of any changes, as they are binding on you.
